BackgroundDespite rapid growth of the scientific literature, no consensus guidelines have emerged to define the optimal criteria for editors to grade submitted manuscripts. The purpose of this project was to assess the peer reviewer metrics currently used in the surgical literature to evaluate original manuscript submissions.MethodsManuscript grading forms for 14 of the highest circulation general surgery-related journals were evaluated for content, including the type and number of quantitative and qualitative questions asked of peer reviewers. Reviewer grading forms for the seven (...) surgical journals with the higher impact factors were compared to the seven surgical journals with lower impact factors using Fisher’s exact tests.ResultsImpact factors of the studied journals ranged from 1.73 to 8.57, with a median impact factor of 4.26 in the higher group and 2.81 in the lower group. The content of the grading forms was found to vary considerably. Relatively few journals asked reviewers to grade specific components of a manuscript. Higher impact factor journal manuscript grading forms more frequently addressed statistical analysis, ethical considerations, and conflict of interest. In contrast, lower impact factor journals more commonly requested reviewers to make qualitative assessments of novelty/originality, scientific validity, and scientific importance.ConclusionSubstantial variation exists in the grading criteria used to evaluate original manuscripts submitted to the surgical literature for peer review, with differential emphasis placed on certain criteria correlated to journal impact factors. BackgroundCentral to ethically justified clinical trial design is the need for an informed consent process responsive to how potential subjects actually comprehend study participation, especially study goals, risks, and potential benefits. This will be particularly challenging when studying deep brain stimulation and whether it impedes symptom progression in Parkinson’s disease, since potential subjects will be Parkinson’s patients for whom deep brain stimulation will likely have therapeutic value in the future as their disease progresses.MethodAs part of an expanded informed consent process (...) for a pilot Phase I study of deep brain stimulation in early stage Parkinson’s disease, an ethics questionnaire composed of 13 open-ended questions was distributed to potential subjects. The questionnaire was designed to guide potential subjects in thinking about their potential participation.ResultsWhile the purpose of the study (safety and tolerability) was extensively presented during the informed consent process, in returned responses 70 percent focused on effectiveness and 91 percent included personal benefit as potential benefit from enrolling. However, 91 percent also indicated helping other Parkinson’s patients as motivation when considering whether or not to enroll.ConclusionsThis combination of responses highlights two issues to which investigators need to pay close attention in future trial designs: (1) how, and in what ways, informed consent processes reinforce potential subjects’ preconceived understandings of benefit, and (2) that potential subjects see themselves as part of a community of Parkinson’s sufferers with responsibilities extending beyond self-interest. More importantly, it invites speculation that a different paradigm for informed consent may be needed. (shrink)

Thematically organized around the major concerns of Basil Bernstein's work as a sociologist, this book includes chapters from some of the leading sociologists and educational scholars. Each section attempts to provide a critical evaluation of Bernstein's work, framed within four interrelated contexts: his sociological theory, sociology of language and code theory, sociology of education and social reproduction, and the influence of his sociology on educational research. In a separate section, Bernstein himself responds to the earlier chapters. The typical Cartesian collection contains papers which treat the problems arising out of Descartes's philosophy as though they and it appeared for the first time in a recent journal. The approach of this collection is quite different. The eight contributors concentrate on problems faced by Cartesianism which are of historical significance. Without denigrating the importance of the technique of exploiting the texts in a manner that appeals to contemporary philosophical interests, the contributors show how Cartesianism was shaped over time by (...) the criticism it received. This criticism took place in many areas - politics, theology, natural science, and metaphysics - and its scope is reflected in this collection of papers. The efforts of advocates of Cartesianism to produce a biography of Descartes, and the political difficulties they faced, are no less a part of the problems of Cartesianism than are the difficulties alleged against the Cartesian ontology of thought and extension in accounting for transubstatiation. Seventeenth- and eighteenth-century theories of the formation of the earth, for example, were historically part of the same set of problems as the difficulties in Bible criticism. This paper examines several issues regarding deception in advertising. Some generally accepted definitions are considered and found to be inadequate. An alternative definition is proposed for legal/regulatory purposes and is related to a suggested definition of the term deception as it is used in everyday language. Based upon these definitions, suggestions are offered for detecting and regulating deception in advertising. This paper additionally considers the grounds for the generally held but largely unquestioned assumption that deceptive advertising is unethical. It is (...) argued that deceptive advertising can be shown to be morally objectionable, on the weak assumption that it is prima facie wrong to harm others. Finally, the implications of this analysis with respect to current regulation of deceptive advertising by the FTC are considered. (shrink)

The recent accounting scandals at Enron, WorldCom, and other corporations have helped to fuel a massive loss of confidence in the integrity of American business and have contributed to a very sharp decline in the U.S. stock market. Inasmuch as these events have brought ethical questions about business to the forefront in the media and public consciousness as never before, they are of signal importance for the field of business ethics. I offer some observations and conjectures about the bearing of (...) the recent scandals on the literature on business ethics. I defend the following contentions: 1. Recent events reveal serious weaknesses of the stakeholder theory about the social responsibilities of business which lacks prohibitions against fraud and deception. This is a glaring deficiency of standard versions of the stakeholder theory, but it is easily remedied by adding explicit prohibitions against fraud and deception. In addition, recent events highlight the stakeholder theory's very naive and unrealistic hopes and expectations for business executives as moral arbiters and agents of social improvement. 2. Recent events do not constitute an objection to the shareholder theory about the social responsibilities of business, however, these events make evident the implausibility of strong versions of the invisible hand theory. 3. Schemes of payment and reward often create perverse incentives for individuals to engage in unethical conduct. 4. Both the shareholder theory and the stakeholder theory need to add a constraint that requires executives to respect the professional obligations of employees. (shrink)

My interest in the issues considered here arose out of my great frustration in trying to attack the all-pervasive relativism of my students in introductory ethics courses at Virginia Polytechnic Institute and State University. I am grateful to my students for forcing me to take moral relativism and skepticism seriously and for compelling me to argue for my own dogmatically maintained version of moral objectivism. The result is before the reader. The conclusions reached here (which can be described either as (...) a minimal objectivism or as a moderate verson of relativism) are considerably weaker than those that I had expected and would have liked to have defended. I have arrived at these views kicking and screaming and have resisted them to the best of my ability. The arguments of this book are directed at those who deny that moral judgments can ever be correct (in any sense that is opposed to mistaken) and who also deny that we are ever rationally com pelled to accept one moral judgment as opposed to another. I have sought to take their views seriously and to fight them on their own grounds without making use of any assumptions that they would be unwilling to grant. My conclusion is that, while it is possible to refute the kind of extreme irrationalism that one often encounters, it is impossible to defend the kind of objectivist meta-ethical views that most of us want to hold, without begging the question against the non-objectivist. Marr's levels of analysis—computational, algorithmic, and implementation—have served cognitive science well over the last 30 years. But the recent increase in the popularity of the computational level raises a new challenge: How do we begin to relate models at different levels of analysis? We propose that it is possible to define levels of analysis that lie between the computational and the algorithmic, providing a way to build a bridge between computational- and algorithmic-level models. The key idea is to push the (...) notion of rationality, often used in defining computational-level models, deeper toward the algorithmic level. We offer a simple recipe for reverse-engineering the mind's cognitive strategies by deriving optimal algorithms for a series of increasingly more realistic abstract computational architectures, which we call “resource-rational analysis.”. The Socratic Way of Life is the first English-language book-length study of the philosopher Xenophon's masterwork. In it, Thomas L. Pangle shows that Xenophon depicts more authentically than does Plato the true teachings and way of life of the citizen philosopher Socrates, founder of political philosophy. In the first part of the book, Pangle analyzes Xenophon's defense of Socrates against the two charges of injustice upon which he was convicted by democratic Athens: impiety and corruption of the youth. In (...) the second part, Pangle analyzes Xenophon's account of how Socrates's life as a whole was just, in the sense of helping through his teaching a wide range of people. Socrates taught by never ceasing to raise, and to progress in answering, the fundamental and enduring civic questions: what is pious and impious, noble and ignoble, just and unjust, genuine statesmanship and genuine citizenship. Inspired by Hegel's and Nietzsche's assessments of Xenophon as the true voice of Socrates, The Socratic Way of Life establishes the Memorabilia as the groundwork of all subsequent political philosophy. The Life of Wisdom in Rousseau's "Reveries of the Solitary Walker" is the first complete exegesis and interpretation of Rousseau's final and culminating work, showing its full philosophic and moral teaching. The Reveries has been celebrated as a work of literature that is an acknowledged acme of French prose writing. Thomas L. Pangle argues that this aesthetic appreciation necessitates an in-depth interpretation of the writing's complex and multileveled intended teaching about the normatively best way of life—and how essential this (...) is for a work that was initially bewildering. Rousseau stands out among modern political philosophers in that he restored, to political philosophy, what Socrates and his students (from Plato and Xenophon through Aristotle and the Stoics and Cicero) had made central—and that the previous modern, Enlightenment philosophers had eclipsed: the study of the life and soul of the exemplary, independent sage, as possessor of "human wisdom." Rousseau made this again the supreme theme and source of norms for political philosophy and for humanity's moral as well as civic existence. In his analysis of The Reveries, Pangle uncovers Rousseau's most profound exploration and articulation of his own life, personality, soul, and thought as "the man of nature enlightened by reason." ABSTRACT In 1833 John Herschel published a graphical method for determining the orbits of double stars. He argued that his method, which depended on human judgment rather than mathematical analysis, gave better results than computation, given the uncertainty in the data. Herschel found that astronomy and terrestrial physics were especially suitable for graphical treatment, and he expected that graphs would soon become important in all areas of science. He argued with William Whewell and James D. Forbes over the process of (...) induction, over the application of probability, and over the moral content of science. Graphs entered into all these debates; but because they constituted a method, not a metaphysics, they were acceptable to most practicing scientists and became increasingly popular throughout the nineteenth century. People are adept at inferring novel causal relations, even from only a few observations. Prior knowledge about the probability of encountering causal relations of various types and the nature of the mechanisms relating causes and effects plays a crucial role in these inferences. We test a formal account of how this knowledge can be used and acquired, based on analyzing causal induction as Bayesian inference. Five studies explored the predictions of this account with adults and 4-year-olds, using tasks in which (...) participants learned about the causal properties of a set of objects. The studies varied the two factors that our Bayesian approach predicted should be relevant to causal induction: the prior probability with which causal relations exist, and the assumption of a deterministic or a probabilistic relation between cause and effect. Adults’ judgments (Experiments 1, 2, and 4) were in close correspondence with the quantitative predictions of the model, and children’s judgments (Experiments 3 and 5) agreed qualitatively with this account. With _Aristotle’s Teaching in the “Politics,” _Thomas L. Pangle offers a masterly new interpretation of this classic philosophical work. It is widely believed that the _Politics_ originated as a written record of a series of lectures given by Aristotle, and scholars have relied on that fact to explain seeming inconsistencies and instances of discontinuity throughout the text. Breaking from this tradition, Pangle makes the work’s origin his starting point, reconceiving the _Politics_ as the pedagogical tool of a master teacher. With (...) the _Politics_, Pangle argues, Aristotle seeks to lead his students down a deliberately difficult path of critical thinking about civic republican life. He adopts a Socratic approach, encouraging his students—and readers—to become active participants in a dialogue. Seen from this perspective, features of the work that have perplexed previous commentators become perfectly comprehensible as artful devices of a didactic approach. Ultimately, Pangle’s close and careful analysis shows that to understand the _Politics_, one must first appreciate how Aristotle’s rhetorical strategy is inextricably entwined with the subject of his work. Situation selection involves choosing situations based on their likely emotional impact and may be less cognitively taxing or challenging to implement compared to other strategies for regulating emotion, which require people to regulate their emotions “in the moment”; we thus predicted that individuals who chronically experience intense emotions or who are not particularly competent at employing other emotion regulation strategies would be especially likely to benefit from situation selection. Consistent with this idea, we found that the use of situation selection (...) interacted with individual differences in emotional reactivity and competence at emotion regulation to predict emotional outcomes in both a correlational and an experimental field study. Taken together, the findings suggest that situation selection is an effective strategy for regulating emotions, especially for individuals who otherwise struggle to do so. (shrink)

Information changes as it is passed from person to person, with this process of cultural transmission allowing the minds of individuals to shape the information that they transmit. We present mathematical models of cultural transmission which predict that the amount of information passed from person to person should affect the rate at which that information changes. We tested this prediction using a function-learning task, in which people learn a functional relationship between two variables by observing the values of those variables. (...) We varied the total number of observations and the number of those observations that take unique values. We found an effect of the number of observations, with functions transmitted using fewer observations changing form more quickly. We did not find an effect of the number of unique observations, suggesting that noise in perception or memory may have affected learning. (shrink)

This article critically reviews the present condition of burial law. Situating burial within the wider context of the ‘law of the dead’, it is observed that contemporary changes to the law have served to clarify and reinforce the individual’s power to determine what will happen to his or her organs and tissues upon death. An equivalent right to posthumous bodily self-determination has not been extended to the neglected area of burial, and it is recommended that burial law therefore needs to (...) be updated. A series of solutions is elaborated in order to illustrate how these developments could be realized effectively in practice. (shrink)

Jeffrey Tulis’s classic study traces the central dilemmas of today’s presidency to Woodrow Wilson’s invention of the full‐blown “rhetorical presidency”: a radicalized version of Theodore Roosevelt’s essential rhetorical supplement to the Founders’ inadequate conception of the office. But what is Tulis’s teaching as to how we ought to evaluate this transformation? Tulis shows that our system suffers from a profound constitutional contradiction, with attendant deleterious consequences for our civic life; and he spotlights major virtues of TR’s “middle way.” What, then, (...) holds Tulis back from endorsing that “moderate” way as superior, even in principle, to the Wilsonian system under which we now live?
